1. AGENTS: We are NOT Licensed Real Estate Agents and do not get involved with the transaction of real estate, the marketing of your property, or the negotiation of fees for the sale of your property. This is done with a licenced Real Estate agent.

2. CONTENT ON OUR WEBSITE: The information contained in this website (and our email communication) is for general information purposes only and should not be used as advice on the selling of your property. We help provide a selection of licensed Real Estate Agents who the vendor can elect to engage with. You are not bound to use the agents we send to you. It is the sole discretion of the home/landowner to select how and who they wish to market their property.

3. WEBSITE:  Information on our site is there to educate and prepare a vendor for when you meet your Licensed Real Estate Agent. It is the job of the Licensed Real Estate agent to give you advice on the sale of your property and ultimately bring about the transaction. We always advise you to obtain your agent or agency to compare against the agents we provide. You should always compare two, if not three, agents and agencies.

4. OUR RESEARCH: We only provide the agent(s) based on our interpretation of your requirements from the limited information provided via the website form, electronic communication, and phone calls. It is your responsibility to hire the agent/agency that you feel is appropriate, having met them, compared agents and agencies (including one of your own accord) and obtained their advice on the value and marketing mythology of your property. We always try to recommend at least two agents where possible. If we have only managed to find one, we always recommend you see another to compare.

Any reliance you place on such information or recommendation of a real estate agent is, therefore, strictly at your own risk.

 5. WARRANTIES: We make no warranty on the quality of advice from your licensed real estate agent. Whether an agent is appropriate for your property is solely your decision from meeting them in person or via electronic media.

6. OUR ROLE: We only search for agents at the time of your request. We cannot guarantee that an agent or agency will accept a referral from us at the time of your request. We will always use the following best agent available on our database if no others can be found or agree to accept a referral.  It is the sole discretion of our team who we feel the right agent (or agency) is. We encourage you to perform your diligence (on our agents and any agents you may choose to meet). To help you, we provide a Q&A sheet to help interview your agent.

7. YOUR AGREEMENT WITH AGENT: We will not be held liable for any agreement you enter with the real estate agent or seller. This is solely your responsibility, and you should always seek legal advice before entering any contract for the sale and purchase of real estate.

8. SERVICES: My Top Agent makes no guarantees about the fit for purpose, personality, or suitability of the real estate agent for your needs as a property seller/vendor. The information we give you via phone or email is merely a tool to help you make your final decision as to who is the best agent for your own needs and purposes. Our service is to help vendors recruit agents to interview for the sale of their properties. We are a recruitment company for real estate agents and only receive payment based on a success fee. Please read all the conditions below before you decide to continue with our service. If you prefer to work outside a success fee, our rates are based on initial research, property reports and agent recommendations. Costs are based on $350 per hour, plus GST (Est costs $900 – $1,200)

9. OUR CONTACT: We will contact you via phone to confirm you are the property owner and or if your property is currently listed. If we have spoken to you on an initial phone call and can’t reach you after three attempts, we may have the top agent contact you directly.

10. AGENT CONTACT: If you have requested for the agent not to contact you on ouor initial call, we will not give you details. We respect your privacy.

11. INFORMATION: We endeavour to keep the information contained on this site and in our emails up to date and correct; we make no representations of any kind, express or implied, about the completeness, accuracy or availability concerning1 the information on our website

12. LIABILITY: In no event will we be liable for any loss or damage, including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.

13. WEBSITE: Through this website, you can link to other websites that are not under the control of My Top Agent. We have no control over the nature, content and availability of those sites. Including links does not necessarily imply a recommendation or endorse the views expressed within them.

14. ADVICE: Our advice on the Top Agent is general only, and whilst every effort is made to find your Top Agent, we have no control over how the agent you choose may work with you or the decisions they will make about the negotiation, marketing and sales methodology.

15. RESPONSIBILITY: Every effort is made to keep the website running smoothly. However, My Top Agent and Fly Me High Limited take no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control. We do not get involved in the transaction of any Real Estate work or negotiation of any Real Estate transactions, nor do we advise on how you should market your property. We do, however, provide general about getting your house ready for an inspection with a licensed Real Estate Agent, and this is general only.

16. OUR SERVICE: We are a recruitment firm that finds Top Real Estate Agents, so please do not ask for advice on property value or likely selling price that your licenced Real Estate professional can give you.

17. HOW WE GET PAID: We get paid a pre-agreed marketing referral fee. Each agent has agreed to this as a ‘Marketing Referral Fee’ for all referrals we give them.
My Top Agent does not get involved with the sale, fees or marketing conditions of your property. We only get paid once the agent has received consideration for their efforts in completing the sale of your property.
